Add WTEN to the list

"Saving Private Ryan" Pre-emptend on WTEN-TV
WTEN here in Albany is among the stations refusing to air "Saving Private Ryan" out of fear of the FCC.

This has been a difficult and agonizing decision for us. However, we have a responsibility to operate in accord with the law, and until the FCC or the courts clarify what the broadcast legal standards are for programs of this type, we will continue to be confronted with these difficult choices.

Here's what's going to make this interesting: there were some complaints filed against the stations that did show the movie.

If the FCC does not fine them, then that will give future cases grounds for an appeal in court. "Hey, they let ABC get away with it, why not us?"

If the FCC does fine them, then ABC will have grounds for an appeal -- because there were complaints the previous two time the movie aired back in the pre-Bono/Janet Jackson days. The FCC decided it didn't merit a fine then. So how can hey justify one now?

They're damned if they do and damned if they don't.
